Some consulting arrangements must meet federal criteria, while others must include a certificate of insurance. In a recent IRS publication, the courts have determined that there are three qualifying categories that determine your work status:
- Behavioral Control: These facts show whether there is a right by the business to direct or control how the IT work is to be done. An IT worker is an employee when the business has the right to direct and control the worker. The business does not have to actually direct or control the way the IT work is done as long as it has the right to direct and control the work.
- Financial Control: These facts show whether there is a right to direct the business part of the work. For example if you have a significant investment in your work and your expenses are not reimbursed, you may be an independent IT contractor. If you can realize a profit or incur a loss you may be an independent IT contractor.
- Relationship of the Parties: These facts relate to how the parties view their relationship. These include things like benefits such as insurance, PTO, etc. If you have these, this is an indication you’re an employee. A written contract may show what the parties intend if it the relationship is otherwise unclear.
